The pollution notification or “toxic spill bill” continues to gain momentum in Tallahassee as the 2017 legislative session continues. The bill, sponsored by Republican State Senator Bill Galvano of Bradenton is largely a response to Governor Scott’s Emergency Pollution Notification Rule that was enacted last year in response to the Mosaic spill in Polk County. That rule was invalidated by an administrative law judge which gave the states' legislators even more motivation to have legislation considered and adopted this session. The Environmental Preservation and Conservation Committee of the Senate has offered a substitute to SB 532 which requires companies to report, within 24 hours, to the FDEP any reportable pollution release and details on the substance released, the circumstances of the release and the installation of release.
