The UK Border Agency has recently confirmed what the immigration department at Penningtons Solicitors LLP was already aware of in relation to restaurant establishments offering take-away and/or buffet services and applying for a tier 2 sponsor licence.

Any applications for a tier 2 sponsor licence from restaurants offering a take-away service, regardless of the proportion of the service, will be refused by the UKBA. Similarly if a restaurant routinely offers a buffet service rather than an ad hoc service for functions, the tier 2 sponsor licence application will also be refused.
