The Irish Presidency has published a memo outlining the progress made by the European Council in reviewing the Regulation since the beginning of the Irish Presidency. Particularly of note are:
- The Presidency has now finished a first examination of the entire proposal
- The Council has previously required for a more risk-based approach to be taken and for flexibility to be provided for the public sector. This has been incorporated into amendments made by the Presidency for consideration at the next meeting.
- Differences of approach remain over the requirement for prior consultation with DPAs, the obligatory nature of DPOs and the linking of codes of conduct and certification mechanisms to a risk based approach
The memo outlines a draft agenda for the orientation debate to take place on 8 March 2013.
