Monday, 22 April 2013, saw the release of the latest versions of the NEC3 forms of contract. In response to attempts to improve supply chain payments, the suite of contracts has been amended to allow for the use of project bank accounts. These comprise single project specific accounts into which the client makes all payments and from which all contractors and sub-contractors withdraw their payments, seeking to increase fair payment to the supply chain by eliminating delays in payments to sub-contractors.

The NEC3 April 2013 editions also incorporate reference to the Construction Industry Council’s recently published BIM Protocols and have been updated to meet the requirements of the Local Democracy, Economic Development and Construction Act 2009.

The launch also sees the introduction of a new ‘Professional Services Short Contract’. Developed in conjunction with the Association of Project Managers, this new standard form of contract adapts the existing ‘Professional Services Contract’ for use on smaller scale projects where shorter term appointments are more appropriate.

As well as the new and revised forms of contracts, seven ‘how to’ guides have been published to assist with the preparation of the contracts. The topics covered include:

  • How to write the ECC Works Information;
  • How to use the ECC communication forms;
  • How to write the PSC Scope;
  • How to use the PSC communication forms;
  • How to write the TSC Service Information;
  • How to use the TSC communication forms; and
  • How to use BIM with NEC3 Contracts.
