On 12 August 2010, the Financial Services Authority (FSA) issued a revised edition of its July 2010 letter to firms regarding legal expenses insurance. The revisions comprise two footnotes. The first footnote explains that the European Court of Justice (in its ruling in Erhard Eschig v UNIQA Sachversicherung AG) has stated that the freedom to choose a lawyer under Article 4 of the EU Directive on legal expenses insurance (Directive 87/344/EEC) is guaranteed, but can be restricted in certain cases. The second footnote explains that the right of the insured to choose a lawyer under the UK Regulations implementing Directive 87/344/EEC occurs when negotiations have failed and legal proceedings are necessary.
