The consultation is being conducted on behalf of the Civil Procedure Rule Committee and proposes amendments to Part 44 CPR by inserting rules on costs capping orders. The proposals include orders to be made against any of the parties where the court is not satisfied that the risk of costs disproportionately incurred could not be adequately controlled by case management and detailed assessment of costs. Amendments to the Costs Practice Direction to provide guidance on costs capping are also proposed. The proposals are drawn from current case law and therefore do not propose new policy. The Consultation process closes on 24th October.
