In a speech given on 6 March 2014, David Green CB QC has reinforced the levels of co-operation expected from those organisations seeking DPAs. Addressing head-on one of the practically more difficult issues for organisations contemplating self-reporting, he commented that cooperation would include “A waiver of  privilege,  where  necessary. This applies particularly to privilege which is often claimed, dubiously, over accounts given by witnesses in internal investigations. Of course, waiver cannot be compelled, but waiver of privilege where necessary would be an obvious sign of cooperation.” The speech provides a useful first indication of the Director’s approach now that DPAs are ‘in play’ as a tool for the SFO.
