On January 31, 2007, the European Commission announced that it was closing its investigation into the distribution system of De Beers, the South African rough diamonds producer and supplier. The Commission decided to drop the investigation after De Beers agreed to revise its Supplier of Choice rough distribution agreement (“SOC”). The SOC had been approved by the Commission in 2003, but complaints were subsequently filed with the Commission claiming that the system was non-transparent and enabled De Beers to gather sensitive commercial information from clients. This could lead to arbitrary decisions preventing access by non-clients to the rough diamond market. The revised SOC will filter client information received by De Beers and increase the transparency of the criteria used by De Beers to select its customers.
