In 2015, the EPA and the Army Corps adopted a final rule defining the waters of the U.S. that many felt was overly expansive – some even saying that by definition the entire state of Florida could be considered a “waters of the US.” According to the EPA, when finalized, this new rule would “provide certainty in the interim” while a second rulemaking process is undertaken to more fully redefine “waters of the US.” EPA Administrator Scott Pruitt stated that the agency is taking action “to return power to the states and provide regulatory certainty to our nation’s farmers and businesses.”
