These draft Regulations clarify the position in relation to benefits other than pay to which employees on additional maternity or adoption leave are entitled.

They remove the distinctions between employees’ rights to pay and non-pay benefits during periods of ordinary maternity or adoption leave and periods of additional maternity or adoption leave. These amendments will apply in cases where the expected date of birth or adoption is after 5 October 2008.

While these Regulations may impose increased costs for employers’ in providing non-pay benefits such as company cars and gym membership, it is not intended that there should be any effect on occupational pension provision.
