The Colorado Division of Real Estate ("Real Estate Division") recently issued a Legislative Summary and Resource Handout confirming that all pre-CCIOA associations that have not elected treatment under CCIOA are exempt from registration. A pre-CCIOA association is any association organized before July 1, 1992, the effective date of the Colorado Common Interest Ownership Act. Similarly, all purely commercial associations and voluntary associations are also exempt from registration. As discussed in a previous client alert, Governor Ritter signed into law House Bill 1278, requiring that all unit owner associations register with the Real Estate Division effective January 1, 2011.
