The Financial Services and Markets Act 2000 (Regulated Activities) (Amendment) (No 3) Order 2015 has been published. In summary, the Order amends the FSMA (Regulated Activities) Order 2001 to clarify the way first charge mortgages dated prior to 31 October 2004 should be treated, and makes changes to ensure consistency with the regulatory regime for mortgages following the implementation of the Mortgage Credit Directive. The provisions of the Order are being implemented in stages, the specific commencement dates can be found in Article 1 of the Order.
