These Regulations provide for the partial transposition of the EU Directive 2008/101/EC (the Aviation Directive) which extends the EU Emissions Trading Scheme (ETS) to aviation activities. All flights arriving at and departing from EU airports will be included in the ETS from 2012. The Regulations provide for the submission of monitoring plans to the EPA, which has been designated as the competent authority for the purpose of the Aviation Directive.

The European Commission's Monitoring and Reporting Guidelines for emissions data from aviation activities, requires aircraft operators to submit monitoring plans to the competent authority for approval at least 4 months prior to the start of the first reporting period. The first reporting year is 2010. Therefore aircraft operators must submit their monitoring plans to the EPA before the end of August 2009.
