A recent EPA change restores requirements for facilities that use or emit toxic chemicals to file annual reports under federal environmental laws, the Emergency Planning and Community Right-to-Know Act and the Pollution Prevention Act (EPCRA and PPA).On April 21, EPA reversed its Toxics Release Inventory Burden Reduction Rule, a December 2006 rule that reduced reporting requirements for facilities using less than 5,000 pounds of toxic chemicals, or releasing less than 2,000 pounds, allowing these facilities to submit shorter, less-detailed certifications. EPA's action will require facilities using 500 pounds of toxic chemicals to once again file full Form R reports.
