On 8 March 2018 the European Commission decided to refer Croatia to the Court of Justice of the European Union since its national legislation is not in line with Regulation (EC) No 300/2008 on common rules in the field of civil aviation security.
Despite repeated request from the European Commission, Croatia has not changed the relevant legislation to comply with the European rules on aviation security. Therefore, the Commission initiated the infringement proceedings in front of the Court of Justice.
In particular, Croatia is required to update its legislation regarding organisational structures, responsibilities and mechanisms to monitor activities at national airports, vis-à-vis airlines and aviation security related entities.
This is a matter of administrative nature that is not linked to security shortcomings.
