EPA has issued guidance for filing exemption petitions under the Mercury Export Ban Act of 2008. The Act aims to cut the amount of mercury circulating in the environment by reducing its volume in international commerce. It prohibits the export of mercury as of January 1, 2013, and requires the U.S. Department of Energy to operate one or more mercury storage facilities in the United States.
The law allows parties to petition EPA for an exemption. The EPA guidance addresses (i) information that should be included in the petitions, (ii) where the petitions should be sent, (iii) confidential business information, and (iv) how EPA will decide on whether to grant the petitions. The guidance also summarizes other laws that regulate mercury in the environment and cross-references relevant mercury-related guidance.
