The Ministry of Economic Development of the Russian Federation has recently published a new draft law intended to facilitate incorporation of Federal Law No. 323-FZ “On the Fundamentals of the Protection of Citizens’ Health in the Russian Federation”, dated 21 November 2011, into existing Russian legislation.

The following key features of the draft law are likely to be relevant to pharmaceutical and medical devices companies:

  • the draft law introduces administrative liability for violations of healthcare legislation, including for violations of the rules on interactions between pharmaceutical and medical devices companies and medical and pharmaceutical professionals;
  •  the draft law introduces rules on interactions between pharmaceutical companies and medical and pharmaceutical professionals into the Law on the Circulation of Medicines. For the most part those rules mirror previous requirements but they also attempt to specifically govern events involving medical and pharmaceutical professionals; and
  • the draft law aims to resolve some of the terminology confusion that has been created by recent legislative changes.

The draft law is currently undergoing public hearings.
