A firm of solicitors in Southport won a tender to carry out conveyancing work for Britannia Building Society. Little did the firm know that an employment tribunal would find that some of the employees who used to carry out work for Britannia Building Society at another firm of solicitors would transfer over under TUPE.
The tender winner's victory was short-lived, when they found themselves stuck with unfair dismissal and failure to inform and consult claims from the transferring employees.
This is the first known example of a firm of solicitors winning a new client and finding themselves with their predecessor's employees under TUPE.
