The Government's latest proposed changes would result in developer's being able to apply to local authorities and then the Planning Inspectorate to re-open previous contributions/obligations they have agreed to pay in relation to a development through a section 106 planning agreement, if they can show that those costs make the scheme unviable. Agreements need to have been entered into pre-April 2010.
