Our client, a young woman who suffers with mental health problems, has secured a settlement in her legal claim for the sexual, physical and emotional abuse she was subjected to by a mental health support worker whilst under the care of the NHS.
The client, who wishes to remain anonymous, took the claim over allegations that she was sexually assaulted by the trust’s employee on multiple occasions, and over several years, whilst he was assigned to her as a support worker by the trust’s Community Mental Health Team.
Despite concerns being raised by other employees about the perpetrator’s conduct towards our client, who is a very vulnerable woman, as early as 2009, action was not taken by the trust until 2011, when the perpetrator was finally dismissed from the trust and reported to the police.
The perpetrator was charged with multiple counts of sexual assault, relating to our client and another individual, and later convicted of several counts of ‘sexually abusing a person with a mental disorder’ under section 38 of the Sexual Offences Act 2003.
“Our client has been greatly affected by the assaults that she suffered, and the huge breach of trust committed by the trust’s employee, whose very role it was to support her in managing and recovering from her mental health problems, so that she could regain her confidence, rebuild her trust in those around her and return to an independent life.
“Whilst no amount of money can ever compensate her for the abuse she has suffered, it is hoped that the compensation she has secured may provide some assistance to her, by allowing her to access the independent support services that she now needs”.
