The Maternity and Parental Leave etc and the Paternity and Adoption Leave (Amendment) Regulations 2008 have been published in draft. They will apply to employees whose expected week of childbirth begins on or after 5th October 2008; to an employee whose child is expected to be placed with him for adoption on or after that date; or, in the case of an overseas adoption, an adopter whose child enters Great Britain on or after that date.

The regulations remove the distinctions between employees on ordinary maternity leave (OML) and those on additional maternity leave. They also remove the distinctions between employees on ordinary adoption leave (OAL) and additional adoption leave. This means that the terms and conditions enjoyed during OML or OAL will be enjoyed during any additional leave. This includes seniority, pension and similar rights.
