The U.S. Court of Appeals for the Eleventh Circuit has upheld the dismissal of LabMD’s complaint against the Federal Trade Commission, which challenged the agency’s authority to bring an enforcement action against the company for failing to employ adequate measures to protect personal information of patients.  Previously, the U.S. District Court for the Northern District of Georgia ruled that it lacked subject-matter jurisdiction to rule on LabMD’s complaint because the FTC had not taken a “final action for which there is no other adequate remedy.”  The appeals court upheld the district court’s judgment on the same ground.
