The Scottish Government has launched a consultation on establishing guidance on the use of compulsory purchase powers by planning authorities and other statutory undertakers, as well as guidance of disposing of publicly-owned land.

The Consultation does not propose changes to the existing law, but rather provides guidance for those most likely to encounter compulsory purchase orders (CPOs): whether on the part of the public authority exercising a CPO, or as a land owner affected by a CPO. In similar fashion, the Consultation provides guidance on the exercise of and disposal procedure of publicly-owned land.

Interested parties have until Friday 6 May 2011 to submit their responses to the Scottish Government.
