In an enforcement saga that began in 1994 and ultimately muddied and changed Clean Water Act wetlands jurisdiction yet again, John Rapanos ended his litigation by reaching an agreement with EPA regarding unauthorized filling of Michigan wetlands. In a proposed consent decree, Rapanos would agree to pay $150,000 in civil penalties, mitigate 54 acres of illegally-filled wetlands, and to preserve an additional 134 acres of unaffected wetlands. The consent decree does not extinguish the parallel criminal matter against Mr. Rapanos.
