As anticipated in our earlier report, 'Minimum E rating for lettings still on track for April 2018', the regulations which will outlaw letting property with less than an E rated Energy Performance Certificate have now been made.

From 1 April 2018 landlords will face a fine – which may be as much as £150,000 in the case of commercial premises – if they grant a lease where the EPC rating is F or G. Our briefing, 'Minimum energy efficiency standard for commercial buildings: issues for landlords and tenants' published in In House Lawyer contains more details about how the regulations apply to commercial property.

Further Government guidance is anticipated after the General Election about how the rules and any exemptions will work in practice.
