Directive 95/46/EC on the protection of personal data and on the free movement of such data was implemented in Spain through the Data Protection Law 15/1999 on December 13 1999.
Following the allocation of competence in the Spanish Constitution, the autonomous community of Madrid enacted its own Law on Data Protection (8/2001) on July 13 2001. Functions allocated by the Data Protection Law to the Data Protection Agency shall be exercised when affecting databases created or managed by the autonomous community or by local governments within the same, by the corresponding administrative body of each community. For this purpose Law 8/2001, which will apply to all personal databases created or managed by administrative bodies of the autonomous community of Madrid or by local entities within the same, created the Data Protection Agency of the autonomous community of Madrid.
This agency will be in charge of the creation of a Registry of Personal Data, in which all databases shall be registered, and will also have inspection faculties.
