Have there been any changes to IP registration procedures during the covid-19 pandemic?
During the covid-19 pandemic, the National Institute for the Defence of Competition and Protection of Intellectual Property (INDECOPI) created a new online system for applicants to file:
- trademark applications;
- copyright applications; and
- trademark renewals.
INDECOPI also changed the interface of its virtual reception desk. The changes:
- made the virtual reception desk easier to use;
- increased the capacity of filed documents; and
- eliminated the requirement for applicants to file documents physically after three days.
What support has been made available to owners of IP rights during the covid-19 pandemic?
INDECOPI has reduced the official fees required for trademark renewals filed through the online system. In order to reactivate the economy, it has also eliminated the official fees required for filing collective trademark applications. This especially benefits Peruvian entrepreneurs, producers and artisan associations.
Have there been any trends in IP registrations during the covid-19 pandemic?
According to INDECOPI, it received more than 37,000 trademark applications in 2020. This is only 2% less than the quantity obtained in 2019.
However, there has been a notable increase in trademark applications for goods in the healthcare area (eg, pharmaceuticals, alcohol gel and masks).
Have there been any trends in IP infringement during the covid-19 pandemic?
Due to the covid-19 pandemic, INDECOPI has been conducting inspection visits in customs warehouses remotely to prevent imported goods that could be infringing IP rights from entering the market (border measures). This new method of inspection visit makes the procedure faster and less expensive, since the strict security protocols to enter customs warehouses (eg, personal protective equipment and accident insurance) no longer need to be followed.
