Resolution on Ionizing Radiation
The Ministries of Health and Social Development and Energy and Mines have published a joint resolution (Official Gazette 37,547 of October 11 2002), the purpose of which is to establish a framework for the use and handling of materials, substances and equipment that generate ionizing radiation. Among other things, the resolution creates a coordinating commission which must propose and analyze new agreements concerning such usage and handling. Both ministries are responsible for coordinating the development of the relevant jurisdictions.
Law on Seeds, Animal Husbandry and Biological Inputs
The Law on Seeds, Animal Husbandry and Biological Inputs was published in Official Gazette 37,552 of October 18 2002. The law aims to:
- protect the rights of holders of new cultivars, materials for animal husbandry and biological inputs;
- encourage genetic research for the development of production technology; and
- guarantee and protect collective intellectual property.
The law establishes provisions for the research, production, certification, inspection and marketing of seeds, animal husbandry material and biological inputs, as well as establishing prices, rates and sanctions to be applied to the services and activities governed by it. Liability for the offences described in the law is personal. However, individuals, principal authors and co-authors, as well as corporate bodies for whose benefit an offence is committed, are jointly liable.
Special Zones for Sustainable Development
Decree 2,022 was published in Official Gazette 37,557 of October 28 2002, establishing the duties of the Ministry of State for the coordination and control of special zones for sustainable development.
Such duties include:
- cooperating with the Ministry of Planning and Development in preparing schemes, programmes and projects for each of the special zones;
- coordinating projects with public and private sector entities; and
- requesting progress and budget reports.
Decree 2,014 was published in Official Gazette 37,563 of November 5 2002, creating a permanent national committee on environmental technical standards, the purpose of which is to coordinate and maintain a process for the examination, preparation, review and updating of such standards to ensure sustainable development and an improved quality of life for the population of Venezuela.
