Supreme Decree 25864 granted Yacimientos Petroliferos Fiscales Bolivianos (YPFB) the authorization to act as an exclusive wholesale distributor for the sale of special gasoline, premium gasoline and diesel oil produced in Bolivian refineries on the internal market.
This measure has been adopted as part of the government's plan to commercialize fully the sale of the refinery products, in accordance with the relevant legislative regulations.
The refinery owners and YPFB shall enter into a purchase/sale contract of the products, for volumes corresponding to the production of the refineries, so that the internal market can be supplied with these products.
Purchase/sale contracts with retailers shall contain:
- the commission amount by barrel, which shall be expressed and paid in American dollars;
- provisions that include YPFB's new conditions as wholesale distributor;
- a guarantee of the sale of diesel oil produced by the refineries; and
- provisions which allow for the protection of the state and the consumer's interests.
The per-barrel commission that YPFB will pay to the retail distributor will be agreed by considering the relevant stations' margins, established in the regulation for the price regime of petroleum products.
