The Competition Commission recently issued a decision determining that Bora Kečić Specijalni Transporti doo and Large Transport doo had engaged in bid rigging in a public tender procedure launched by public utility company Elektromreže Srbije.
By entering into a restrictive agreement, these undertakings significantly restricted and distorted competition. The commission therefore imposed fines of RSD9,792,225 and RSD1,039,300 (approximately €8,000 per company). The companies must pay their fines to the government's budget account within the next three months.
During ex officio proceedings, the commission found that the companies had agreed on the bidding prices and the course of conduct to be pursued during the public tender procedure, depending on the bids submitted by other bidders. The object of the bid rigging was to eliminate the risk of a more favourable bid being submitted and to ensure that Bora Kečić and Large Transport were selected as the most favourable bidders.
