The Competition Authority recently published the Aftermarkets Analysis.(1) The analysis covers warranties, repair services and the sale and use of spare parts for automotive and household appliance industries. The aim of the analysis was to determine the market structure and the relationship between leading undertakings in order to detect any shortcomings in the market (ie, risk of competition law infringement).

The commission invites all undertakings to provide comments by the end of 2016. The study will also be issued to other government institutions (ie, the Ministry of Trade, Tourism and Telecommunications and the Ministry of Construction, Transport and Infrastructure) for comment.

The results of the analysis will be used to draft a decree on group exemption from the prohibition of vertical agreements in the motor vehicle sector, which will transpose EU Regulation 461/2010 into national law. On completing the analysis, the commission will also decide whether there are grounds for instituting infringement proceedings or whether the situation at hand calls only for informing the undertakings concerned of specific competition compliance rules.
