The Competition Council has approved a set of instructions on commitments in the field of mergers and acquisitions. They are intended to offer guidance on required commitments to be implemented by enterprises in order to ensure that mergers and acquisitions are compatible with a healthy competition environment.
The instructions comprise general principles that apply to commitments accepted by the council; they detail the main types of commitment, as well as their specific conditions.
The details of the instructions may be found in Order 688/2010, which was published in the Official Gazette on January 3 2011. In addition, Order 724/2010 was published on January 5 2011. It refers to the enactment of instructions on the subject of conditions, deadlines and the procedure for accepting and assessing commitments in the case of anti-competitive practices.
