Protecting trade secrets in Germany

The new German Trade Secrets Act entered into force on 26 April 2019. It puts the burden of secrecy measures on the owners of trade secrets to ensure protection of their trade secrets. It also provides owners of trades secrets with additional options to protect their intellectual property. The enforcement of trade secrets can be a pivotal tool for protecting a competitive advantage. It may supplement the enforcement of other IP rights such as patents; frequently, the enforcement of trade secrets is the only option to prevent third parties from taking unfair advantage of a company’s IP investments.
