On November 3rd, a divided panel of the Eighth Circuit affirmed the district court and held that the plaintiff, a participant in a defined-benefit pension plan, could not sue defendants, plan sponsors, for violations of their ERISA fiduciary duties because the plan was overfunded during the period in question
