In holding by unanimous decision that liability under the federal civil False Claims Act ("FCA") could not be established against a subcontractor that did not directly submit claims to the government, or use any record or statements, to obtain payment from the government, the U.S. Supreme Court in Allison Engine Co. v. United States ex rel. Sanders, U.S., No. 07-214, provided clear and unambiguous guidance that liability under the FCA cannot attach to conduct that is not material to the government's decision to make payment and that did not involve the party's use of a false statement or record to the government to induce the government to pay the claims at issue
