The National Defense Authorization Act ("Act"), signed by President Obama on December 31st, suggests that a hospital may not be subject to Executive Order No. 11246 ("Order") and its affirmative action obligations if it contracts (or subcontracts) with the federal government solely on the basis to provide services under the TRICARE Program
