The Supreme Court declared that an employee who does not return to her original workplace at the end of her parental leave only because she cannot place her child in a day-care facility or ensure due care for her child (especially through another person), and who does not inform her employer about the reason in due time, will not be considered to have violated their workers obligations and shall not be dismissed from employment
