On September 30, 2009, the U.S. District Court for the Southern District of New York held that the Treaty of Friendship, Commerce and Navigation (FCN Treaty) between the United States and Japan barred claims by a local manager that different treatment of Japanese rotational managers constituted citizenship or national origin discrimination
