A modest claim should only be struck out as an abuse of process if there is no proportionate procedure for its determination. Even where a claim is allocated to the multi-track, the court has general powers to allocate it to the small claims track in the county court under CPR 26 (Sullivan v Bristol Film Studios Ltd).
