On March 17, 2015 the Spanish Market and Competition Commission (CNMC) approved the Report on the application of certain international aspects in the provision of electronic communications services. The report mainly analyses three points:
● For cases in which an operator established in an EU member country other than Spain and from where the service is provided to other countries through subsidiaries, the CNMC is considering the need for registration. However, in cases where operators do not exploit a network or provide electronic communications services in Spain, there will be no obligation to notify to the Operators' Registry.
● In line with other European National Regulatory Authorities, the CNMC must provide subscriber data to publicly available telephone service in Spain for operators seeking to provide directory telephone inquiry services in a EU member country, and which are duly registered in that country.
● In the case of the resolution of disputes between operators that operate in different EU countries, the CNMC raises the possibility of a cross-border dispute, so that the national authorities of each of the operators agree on a joint resolution procedure.
