From time to time, we are asked about the prevalence of arbitration over litigation as a forum for resolving reinsurance disputes. Vince Vitkowsky recently conducted a survey of the attorneys at Edwards Angell Palmer & Dodge, LLP, in both the US and England, as to to their experience. The survey established that out of a total of approximately 280 reinsurance disputes handled by EAPD attorneys in the last ten years, 85% were arbitrated, 15% litigated. (In the U.S., 87% were arbitrated, and in England, 82% were arbitrated.) These numbers include disputes that were settled, as well as those that proceeded through award or judgment.
