On October 22, 2015, Administrative Law Judge Thomas J. Pender of the International Trade Commission (“ITC”) sided with Oblon clients Valeo North America, Inc., and Delmex de Juarez S. de R.L. de C.V. (collectively, “Valeo”), in determining that Respondents Trico Products Corporation and Trico Componentes SA de CV (collectively, “Trico”) violated Section 337 of the Tariff Act based on the infringement of one of Valeo’s patents relating to windshield wipers and components thereof. The decision comes on the heels of a similar Section 337 investigation at the ITC involving Valeo against Respondents Federal-Mogul Corp., Federal-Mogul Vehicle Motorparts Corporation (formerly known as Federal-Mogul Vehicle Component Solutions, Inc.), and Federal-Mogul S.A. earlier this year that resolved multiple litigations between the parties.
