• The General Court has issued its judgment on the appeal against the European Commission’s decision regarding a non-compete clause between Portugal Telecom and Telefónica, which the Commission found prevented the two parties from competing in the other’s home market in breach of Article 101. The non-compete clause was agreed in connection with Telefónica’s acquisition of the Brazilian mobile operator Vivo from Portugal Telecom. The General Court has upheld the Commission’s reasoning, but has found that the fine must be recalculated to exclude certain sales not linked to the infringement. Click here
