In December 2014, the Supreme Court affirmed the decision rendered by the second instance of the Intellectual Property Court dismissing the appeal filed by Jusung Engineering Co., Ltd., in which Applied Materials, Inc. and AKT America, Inc. were accused of violating the Fair Trade Act.  The Supreme Court upheld the finding of the IP Court that there was no violation by Applied Materials, Inc. or AKT America, Inc., and that a patentee’s application for amending patent claims should not be taken as the patentee’s knowledge of the patent’s invalidity.  Therefore, its exercise of patent rights did not constitute a violation of the Fair Trade Act.
