ESMA has published a list of pension scheme arrangements that are exempted from the clearing obligation under the European Market Infrastructure Regulation (EMIR) because ESMA has assessed them as complying with Article 2(10)(c) or (d) of EMIR. See also FReD 5 February. The list confirms 16 schemes have been assessed as eligible, all from the UK, and does not name the schemes although it describes them. The list does not include pension scheme arrangements under Article 2(10)(a) and (b) of EMIR, which automatically qualify for the clearing exemption.
