In July last year we reported the European Court's preliminary Opinion in Kaltoft v Municipality of Billund saying that obesity (regardless of its cause) can amount to a disability under the European Directive if it hinders full participation in professional life on an equal footing with other employees.  Just before Christmas, the European Court confirmed this Opinion, commenting that obesity would, for example, meet the conditions necessary for it to amount to a disability where it results in reduced mobility or the onset of related medical conditions.
