Cold Call Elimination Ltd ('Cold Call') – The ICO has issued a fine to Cold Call in the amount of £75,000.

This rather ironic monetary penalty determination against Cold Call (a Chichester-based cold-call prevention service company which sold cold-call blocking technology) was actioned following an ICO investigation which revealed that the company had been the perpetrator of cold-call tele-sales practices. Despite being placed under a monitoring sanction for 3 months by the ICO in 2014 and subsequently in September and November 2014, the ICO report that complaints about Cold Call's practices continued.

Many complaints came from members of the public registered with the Telephone Preference Service (TPS) "a central opt out register whereby individuals can register their wish not to receive unsolicited sales and marketing telephone calls. It is a legal requirement that companies do not make such calls to numbers registered on the TPS".  

If Cold Call make full payment of the fine by 14 October 2015, the ICO have agreed to reduce the sum to £60,000; although the discount will be withdrawn if Cold Call decide to appeal.

What action could be taken to manage risks that may arise from this development?

Companies should continue to ensure that it and any tele-marketing vendors used comply with the obligations of PECR.
