On October 18, 2011, the Commodity Futures Trading Commission (the “CFTC”) adopted final regulations (the “Final Rules”) on position limits for futures and swaps contracts, revising the CFTC’s earlier publication on January 26, 2011 of proposed rules establishing a position limits regime for 28 exempt and agricultural commodity futures and options contracts and the physical commodity swaps that are economically equivalent to these futures and options contracts.
