The investigation and prosecution of cartel conduct is an enduring enforcement priority for the Australian Competition and Consumer Commission (ACCC).  The Chairman recently signalled that the ACCC is likely to initiate its first criminal proceedings for cartel conduct in 2016.  The penalties for breaching the cartel prohibitions are very severe for the company and individuals involved and in criminal proceedings can include up to 10 years in jail.
