An Ontario judge departed from existing authority in interpreting in an Ontario Employment Standards Act provision entitling employees with at least 5 years’ service to severance pay from an employer having a total payroll of at least $2.5 million. In Paquette c Quadraspec Inc., 2014 ONCS 2431, the Court held that the employer’s global payroll was to be considered in determining whether the obligation to provide severance pay was triggered. Prior case law had held that only the payroll within the province of Ontario was to be considered.
